War and political risk insurance for Ukrainian energy investments
Assess Ukrainian energy investment insurance through insured interests, covered events, exclusions, limits, waiting periods and financing conditions.
Jurisdiction: Ukraine. Sources reviewed . Highly dynamic conditions. Next scheduled editorial review: . Material rule changes require earlier review.
Insurance changes a transaction only when the insured interest, covered event, loss calculation, exclusions and payment conditions match the investor’s actual exposure. A reference to “war-risk insurance available” does not establish a bindable policy for the project.
Separate physical damage, business interruption and political-risk protection. They can address different losses, beneficiaries and triggering events. Keep uninsured construction, market, operational and credit risk visible.
What the institutional sources establish
MIGA’s Ukraine response describes political and war-risk support for investment. Its war and civil disturbance product describes asset-loss and business-interruption protection tied to covered political violence, with temporary interruption possible upon request. Coverage and compensation remain subject to the actual guarantee and terms.
These sources establish a product context, not eligibility or acceptance of a particular energy investment. Do not assume that all domestic or foreign investors, existing assets, historical damage or future projects receive identical cover.
Prepare an exposure-to-cover matrix
Table — scroll horizontally if needed
| Exposure | Question for insurer / guarantor | Transaction implication |
|---|---|---|
| Plant damage | Which assets, causes, valuation basis and limits are covered? | Repair/replacement funding may differ from acquisition value |
| Business interruption | What event, duration, waiting period and loss formula apply? | Cash may be needed before indemnity |
| Transfer / conversion restrictions | Is this a separately covered political risk and under which conditions? | Market FX loss is not automatically protected |
| Government breach / expropriation | Which obligation, remedy and waiting conditions are insured? | Contract or state-risk protection is scope-specific |
| Debt payment | Who benefits and which principal/interest is protected? | Lender protection may differ from equity protection |
| Acquisition or change of control | Must the existing policy be amended or consent obtained? | Cover may not follow the sale automatically |
The questions are editorial diligence prompts. They do not describe the terms of every MIGA or commercial product.
Check the policy before pricing the benefit
Obtain written eligibility feedback, a quote or indication, underwriting conditions and the full proposed wording through controlled access. Identify the insured company/investor, currency, tenor, covered sites and excluded infrastructure. Clarify deductibles, co-insurance, aggregate limits, notification, mitigation and claims requirements.
Distinguish preliminary interest from an executed policy. Check start dates and any conditions that must be satisfied before cover begins. Do not assume already known damage or a known loss is insured merely because a policy is later available.
For an operating acquisition, examine the existing claims history, open notifications and consent or assignment requirements. For a development project, test construction-period cover and the transition to operations. If the lender requires cover before drawdown, make that dependency explicit in the funding plan.
Model the cash gap, not just the insured value
Run a loss scenario with repair time, interrupted receipts, unavoidable expenses, debt service and the expected claims process. State which amounts the policy may reimburse and which remain with the investor. The insured limit is not immediate liquidity, and replacement-cost compensation is not automatically reimbursement of the acquisition price.
Include premiums and continuing conditions in operating cash flow. A lower discount rate or greater leverage should be justified by the actual protection and lender response, not applied because a programme was mentioned in a teaser.
Make cover a defined closing workstream
Table — scroll horizontally if needed
| Milestone | Evidence | Responsible party |
|---|---|---|
| Eligibility | Written project-specific response | Sponsor / broker / institution |
| Terms | Wording, limits and exclusions reviewed | Investor and qualified advisers |
| Funding condition | Lender acceptance and required beneficiary rights | Financing parties |
| Effectiveness | Executed instrument and satisfied conditions | Transaction team |
| Ongoing compliance | Notification and renewal calendar | Project owner / operator |
Do not publish private underwriting files, security details or precise infrastructure coordinates. Read the bankability guide and financing channels. Discuss your mandate, including the protection your investment committee requires. Cover must be assessed by the insurer and appropriately qualified advisers.
